Update: Noveshen’s 2nd American Express Lawsuit for Breach of Contract (Refusing to pay Bill).

Update on the second American Express lawsuit against Eric Noveshen.

It was filed in June 2016. Noveshen was served in July, 2016.

Noveshen asked for an extension of time to answer. A defendant usually has 20 days to answer a complaint.

A hearing was finally held on October 18, 2016. Noveshen did not even go. Maybe he’s too cool for Court, nah he loves the place. He knows he didn’t have to go and he still ended up getting a couple extra months to file an answer. (instead of being due in September) he gets until November.

American Express Serves Noveshen

Attorneys for American Express didn’t play the dodge service, then file a motion to quash game always played by Eric Noveshen. They just enlisted the Broward Sheriff Dept. to serve Noveshen.

Noveshen used a different first answer. On August 14th Noveshen asked for a 60 day extension of time to answer the complaint. He said that Amex didn’t serve him until “late July,” July 14th would be middle of July if you can count. They tried to serve him on July 7th but he didn’t answer the door.

Lil Wayne is being sued for $86,396.75 in unpaid bills. Eric Noveshen was sued in Broward County, Florida in 2008 by American Express for a similar amount, $81,354.24. Noveshen was sued again by Amex in June 2016 for $29,000 for new unpaid bills.

Pull some strings and find a mediator office you have a friend of a friend who works there like people speculate Noveshen did. Amex lawyers won’t know and may not care they are only hired by Amex, you’ll have a leg up.

Eric Noveshen /his company Bridgwater Advisors were sued agiain by American Express for unpaid bills of $29,000. You can watch that case to see if Noveshen has any new legal tricks up his sleeve to get out of paying debt. It’s brilliant on one hand, on the other it’s a shame the legal system allows it to burden the courts.

OOPS…. Eric Noveshen did it again! Charged thousand$$ on his American Express Card, sent them a check that bounced and now is being sued for the second time by American Express.

Any guesses how Noveshen will handle this one? Will he deny part of the bill is his like he did in 2008 when he lied and said close to $20,000 was fraud? Will he get his pro se litigant guns loaded and head to the Broward Court house and embark on another six year legal battle with American Express?

One thing is for sure – every other American Express card holder in the WORLD pays higher fees due to financial misconduct like this.

We received dozens of emails of outrage regarding the last blog, “Broward Judges Signatures Were Forged by Florida Attorney.” Both in reaction to the Miami attorney forging signatures of seven Broward Court judges and outrage on Eric Noveshen and his mother Cheryl Wilson’s sickening abuse of the court system to reduce their American Express credit card debt from $80,000 to $30,000 (paying none of Amex six years of court fees due to Noveshen’s abuse of Florida’s courts). All while costing the tax payers and American Express thousands of dollars in court time.

The legal games Noveshen and Wilson played in American Express v. Cheryl Diane Wilson and Eric Noveshen, played out for SIX years! He devoted six years of his life to this one case (out of his 43 cases). American Express filed against card members Wilson and Noveshen in 2008 for breach of contract. Filing bankruptcy wasn’t an option for Noveshen because he had disposed of thousands of dollars of credit card and other debts by filing for bankruptcy in 2005. What to do? Most people might try to negotiate down the debt or make a payment plan. But that’s no fun for a conniving mind who gets a high off of seeing how much his lies in can earn him in court. Hence the games begin.

  1. Noveshen’s first move, file a Motion to Quash Service. In this case his mother was clearly served so he started with “deny deny deny” (you owe the debt).

 

2. Then a claim of, was never served documents. This claim can be seen in almost all of his 43 cases.

Then comes the delusion, that is if Noveshen really believes what he files, as he claims it is truth under penalty of perjury: that AmEx in trying to collect the $80,000 that Noveshen enjoyed charging, is guilty of harassing and causing harm to Noveshen. Huh?

You read right, this is a classic Noveshen technique. If law schools taught a course called “Eric Noveshen Strategy” it would teach how to accuse the opposing party of harassing your client. Noveshen’s “poor me” claims are used in almost all of his 43 cases.

3. Accuse opposing party of harming you: Noveshen accuses American Express of “abusing the judicial process” to “harass, intimidate and oppress the Defendant/Counter-Plaintiff Eric Noveshen.” 

Comically he also accuses American Express of causing him “emotional discomfort and distress…” It is so distressing to be enjoy the fruits of spending $80,000 then being asked to pay the bill isn’t it? Delusional? or does he believe this to be true?

This is how the Eric Noveshen court games begin. Disgusting for those people who actually work hard to try to pay their bills and pay higher fees because of scam-artists like Noveshen who skillfully manipulate the courts to his financial advantage time and time again.

How Ribotsky and “The Purchaser”Kept NIR’s AJW Fund Fraud Alive

A recent blog sited a 2011 SEC complaint against the NIR Group and Corey Ribotsky. Part of the complaint stated Ribotsky “entered into a multi-million dollar transaction with the Purchaser and his entities that was clearly not in the best interest of the AJW Funds.” The complaint further states, “Prior to entering into the debenture transactions in November and December 2008, Ribotsky knew and in fact told others the Purchaser’s character and reputation for honesty were suspect.”

There was much speculation on several investment boards that “the Purchaser” was Eric Noveshen. Ribotsky commissioned an investigation into the Purchaser’s financial condition, part of the report summary:

We wondered why would Ribotsky enter into a multi-million-dollar transaction for AJW Funds with a “Purchaser” he clearly knew was not financially sound enough to pay his own credit cards?

The SEC summed it up simply, the transaction, that was sure to fail, allowed Ribotsky to report “a “realized” gain at a critical time without his funds actually receiving any money.” In other words it allowed him to defraud AJW investors longer. We don’t know if “the Purchaser” was compensated for assisting in this act of fraud.

Speculation that the “Purchaser” was Eric Noveshen was not limited to the timing of his Edooorways deal with NIR. The SEC complaint says the Purchaser had many debts. Court records show many lawsuits were filed against Novehsen, his companies and straw buyers, for failure to pay credit cards and other obligations in 2008 and 2009, below are just a few.

The home he resided in went into foreclosure in 2008 as well. And his Former Wife found document’s apparently showing “clear wrong doing in the nature of mortgage fraud” likely occurred in Noveshen’s obtaining the use of that property.
